President Nicușor Dan promulgated on Friday morning the law regarding the pensions of magistrates, emphasizing that recalibrating the way they are calculated is a gesture of equity awaited by society.


The promulgation took place after the publication of the reasoning of the Constitutional Court, which confirmed the constitutionality of the law.


Dan assured the magistrates of respect for their work and promised support for the legislative measures necessary to improve working conditions.


“Recalibrating the way these pensions are calculated is a gesture of equity, awaited by our society. The trust of citizens in the state is regained when the reforms awaited by society become reality,” wrote Nicușor Dan on Facebook.


The Courts of Appeal have requested a re-examination of the law regarding the pensions of magistrates after it passed the CCR


The CCR's decision regarding the constitutionality of the law, which establishes that the pension of a former magistrate cannot be more than 70% of the last net salary received and gradually raises the retirement age to 65 years within 15 years from the entry into force of the law, was made on February 18, with 6 votes to 3. Thus, the CCR rejected the challenge from the Supreme Court, led by judge Lia Savonea, filed in December of last year.


However, the Courts of Appeal and the National Union of Judges of Romania have requested a re-examination of the law, arguing that it could create inequalities between different categories of magistrates. Judges also criticized the attitude of Prime Minister Ilie Bolojan, accusing him of an authoritarian mentality in relation to justice.


The reasoning of the Constitutional Court emphasized that national legislation establishes the amount of pensions, without infringing on private property rights.
