Thursday, September 10, the Disciplinary Section for Judges of the Superior Council of Magistracy admitted the proposal of the Judicial Inspection and ordered the suspension from office of judge Liliana Cătălina Alexe, from the Bucharest Court of Appeal, who was involved in the ROMATSA case.

The suspension remains valid until the disciplinary proceedings opened by the Judicial Inspection are definitively concluded. The decision may be challenged within five days of notification before the Panel of Five Judges of the High Court of Cassation and Justice.

In February, Liliana Alexe had decided to suspend, for a period of one month, ROMATSA’s certificate as an air traffic services provider, in connection with the way the institution hired air traffic controllers. At the hearing concerning the appeal filed against the decision, the judge allegedly appeared in the High Court courtroom to present her arguments. The panel reportedly informed her that she had no standing to address the court, and after she allegedly insisted, she was removed from the courtroom by gendarmes.

The Judicial Inspection launched checks and proposed the magistrate’s suspension. Last week, the High Court admitted the appeals filed by ROMATSA and the Romanian Civil Aeronautical Authority against the judgment of the Bucharest Court of Appeal. The impact of the certificate’s suspension on the continuity of air navigation services and the security of the airspace had also been analyzed at the CSAT meeting in June.
