Alex Florența and Marius Voineag were unable on Tuesday to convince the Prosecutors' Section of the CSM, which resumed voting for their appointments as deputy prosecutors of DIICOT and the General Prosecutor's Office, recording again a tie of 3 to 3.

This situation makes it impossible to issue a consultative opinion and it goes further to the president, according to the law, for the Minister of Justice, Radu Marinescu.
"If this situation were to persist until the moment when the 30 days reserved for the CSM to give an opinion would pass. If an opinion cannot be given, because this tie situation exists, the legal situation is synonymous with the lack of an opinion. Nothing encourages me and nothing helps me, as long as I strictly adhere to procedure, to legal rules. If there is no opinion, we go further to the president. And the president decides. In everything, the president decides until the end, obviously," says Radu Marinescu to OFF The Record, on Mediafax, when asked about the situation in the CSM where the Prosecutors' Section expressed a vote of 3 votes for and 3 against in the case of Alex Florența and Marius Voineag.
Radu Marinescu explained that his proposals are based on concrete arguments and that he is waiting for the motivated decisions of the CSM to continue the selection process. This complicated situation raises questions about the future of appointments to key positions in the judiciary.
Favorable opinions were received by Codrin-Horațiu Miron, Viorel Cerbu, and Marius Ionel Ștefan, while Cristina Chiriac, Gil Julien Grigore Iacobici, and Marinela Mincă received negative opinions.
The CSM's opinion is consultative, and the final decision belongs to President Nicușor Dan, who mentioned that his analysis regarding the candidates differs from public reactions.
