The Bucharest Court of Appeal will decide on Wednesday whether to extend by 30 days the preventive arrest warrant issued in the name of Călin Georgescu or uphold the ruling of the Bucharest Tribunal, which established that he may be investigated under judicial supervision. The current warrant expires at 23:59, and supporters of the former presidential candidate have already begun gathering outside the courthouse.
The appeal filed by DIICOT will be resolved by a panel consisting of two judges. If the court rejects the appeal, Georgescu will be released from custody and remain under judicial supervision. If the appeal is upheld, he will spend another 30 days in preventive detention. If the judges fail to reach an agreement, the case will be resolved by a tie-breaking panel. If the ruling is postponed until after the warrant expires, Georgescu could leave custody.
The Bucharest Tribunal ruled on Monday that judicial supervision was sufficient and that preventive detention was no longer justified. According to the reasoning, the case file contains no minimum evidence proving the new accusations, nor any evidence supporting the intention to alter or destroy means of evidence.
The judge also pointed out that the defendants had not evaded criminal prosecution and had not attempted to influence the evidence. Călin Georgescu is being investigated in a case in which he is accused of having defrauded a businessman of 1.1 million euros. He has been held at the Capital’s Central Detention Facility since 29 September.
