Former Justice Minister Ana Birchall announced on Thursday that she would sue the Judicial Section of the Superior Council of Magistracy, seeking the annulment of the decision by which she claims she was included on a so-called “blacklist.” Birchall says the decision concerned five posts published on her Facebook page and affected her right to freedom of expression, her reputation, and her public image.
She is challenging CSM Decision No. 1348/2026, adopted after she criticized an appointment to the leadership of the High Court of Cassation and Justice, took part in a protest, and proposed solutions for reforming the judiciary. The former minister maintains that she substantiated her positions with court rulings, decisions of the Constitutional Court, and official documents.
On June 16, 2026, Birchall filed a prior administrative complaint against the decision. According to her statement, the Judicial Section of the CSM rejected the complaint by a vote of 1 to 7. She claims that she was not invited to present her point of view and that she learned about the meeting from the institution’s website.
Birchall says she will challenge the decision in the national courts and, if necessary, in international courts. She also announced that she would inform European partners and international institutions about what she considers to be an institutional deviation. According to the information presented, the CSM did not provide a position regarding the former minister’s accusations.
