Raluca Turcan, PNL deputy, announced the plans for amendments to a legislative project that penalizes the unjustified absences of judges of the Constitutional Court of Romania (CCR). The proposed amendment provides for their individual and financial liability for damages caused to the Romanian state. The initial project imposes the obligation for judges to participate in plenary meetings, penalizing absences with 10% of the gross allowance and introducing the possibility of dismissal in case of repeated absences.
Turcan emphasized the financial risks for Romania, mentioning that the country could lose 231 million euros in European funds due to delays related to the reform of judges' pensions. She invoked Article 52 of the Constitution, which stipulates the state's liability for damages caused by judicial errors, without excluding the liability of judges for negligence. The announcement comes in the context of repeated delays in an important decision by the CCR judges.
