The Constitutional Court of Romania will debate on Wednesday the referral from the High Court of Cassation and Justice regarding the law that establishes the retirement conditions for magistrates and the new method of calculating pensions. The High Court argues that the law is unconstitutional, citing discrimination against magistrates compared to other categories of beneficiaries of service pensions, affecting the independence of the judiciary and legislative ambiguities. The law provides for significant changes, including raising the retirement age and limiting the amount of the pension, which could lead to the de facto elimination of service pensions for magistrates. Additionally, the Opposition has submitted a motion of censure, and the project has received a negative opinion from the Superior Council of Magistracy. This situation highlights the tensions between the legislative power and the judicial system in Romania.
