The Constitutional Court of Romania (CCR) will debate on Thursday the unconstitutionality referral of the law approving Emergency Ordinance no. 21/2026, submitted on May 27 by a group of 53 deputies from various parties.
This ordinance aims to modify the legal framework for implementing the SAFE Program, intended to strengthen the European defense industry. The referral contests both the entire law and certain provisions that exceed the scope of the SAFE regulation, including aspects related to the National Recovery and Resilience Plan (PNRR), local public administration, public service, and public procurement.
The leader of the S.O.S. Romania group in the Chamber of Deputies, Simona Macovei Ilie, emphasized that the normative act violates constitutional principles such as the rule of law, the separation of powers, and the quality of the law. The referral requests the CCR to declare the law unconstitutional in its entirety, as well as certain provisions that regulate matters foreign to the scope of SAFE. The law was adopted in an emergency procedure by both Chambers of Parliament.
