The U.S. Supreme Court suspends restrictions on deporting immigrants to third countries

The Supreme Court of the United States ruled on Tuesday to suspend, until further notice, restrictions on deporting undocumented immigrants to third countries and to take up the case for a ruling on the merits in December. The decision represents a victory for the Trump administration, which challenged the lower courts’ rulings.

By a vote of six to three, the Court blocked the implementation of a decision under which people sent to a country other than their country of origin must be informed and must be allowed to invoke the risk of persecution or torture. The dispute concerns directives issued in 2025 by the Department of Homeland Security, which allow such deportations if the destination country provides guarantees deemed credible by the State Department.

The U.S. administration argued that the courts’ rulings create logistical problems and affect deportation operations, including in the case of people convicted of crimes. Opponents argued that the measures would not prevent deportations, but would merely require compliance with legal procedures.
