Federal Judge Fernando Olguin stated that the photograph on the cover of the album 'Nevermind', which shows Spencer Elden as a baby, cannot be considered child pornography. Elden filed the lawsuit in 2021, accusing the band Nirvana and Universal Music Group of sexual exploitation. The judge concluded that the image does not fall within the realm of child pornography laws, comparing it to a family photo. This is the second time the case has been dismissed, after a previous ruling was overturned by the Court of Appeals.
