The European Commission states that online platforms are responsible for combating illegal content generated by artificial intelligence, including sexual deepfakes, and warns that, in the absence of swift measures, the EU will intervene through the tools provided in digital legislation.

The European Commission has issued a strong warning to platform X regarding the spread of sexual deepfakes generated by artificial intelligence, emphasizing that the protection of children and consent cannot be left to the discretion of technology companies. The EU executive specified that, in the event that the platform does not take action, the tools provided by European legislation will be applied.

In short

The EU considers AI-generated sexual deepfakes as illegal content

Online platforms are responsible for preventing and removing this type of content

The Commission is analyzing the responses and measures adopted by platform X

The EU does not rule out intervention through digital legislation, including urgent measures

During the daily briefing in Brussels, the European Commission described the use of artificial intelligence to generate non-consensual sexual content as "unacceptable," especially when it targets women and children. European officials reminded of the recent statements by the Commission's president, according to which the harms caused by such practices are real and serious.

The Commission emphasized that the primary responsibility lies with the platforms that host or distribute this type of content and that freedom of expression cannot be invoked to justify illegal materials. The EU executive indicated that it has received responses from platform X and that these are under evaluation.

Regarding possible measures, the Commission avoided detailing the next steps but reminded that EU legislation allows for the adoption of proportional and limited measures in situations of serious risk to users. European officials insisted that the enforcement of existing rules is essential for protecting fundamental rights in the digital environment.

The EU executive explicitly rejected the idea of a conflict between freedom of expression and combating illegal content, stating that compliance with European legislation is a mandatory condition for any company operating in the EU market.

In recent years, the European Union has adopted an extensive legislative framework for regulating online platforms, which establishes clear obligations regarding the removal of illegal content and the protection of users. The case of AI-generated sexual deepfakes tests the practical application of these rules and the EU's ability to respond swiftly to emerging digital risks.
