The Polish Minister of the Interior, Marcin Kierwinski, has signed an order requiring civil registry offices to register marriages between persons of the same sex concluded abroad. This measure comes as a result of a historic decision by the Court of Justice of the European Union (CJEU), which established that member states must recognize these marriages.
The order will come into effect within three months and will apply nationwide. Recently, the municipality of Warsaw recognized a marriage between two men, concluded in Berlin, after the couple obtained recognition through the CJEU. Polish authorities initially refused to register it, citing the Constitution which defines marriage as a union between a man and a woman. The CJEU's decision emphasizes the right of EU citizens to continue their family life in any country within the Union. Kierwinski's order will be mandatory for all civil registry offices in Poland.
