Estée Lauder Companies has filed a lawsuit against British perfumer Jo Malone, accusing her of trademark infringement after she used her name in a collaboration with Zara. The dispute centers on the use of the name 'Jo Malone' on the packaging of a collection of perfumes launched in 2022, mentioning that it is a 'creation by Jo Malone CBE, founder of Jo Loves'. Malone sold the Jo Malone London brand to Estée Lauder in 1999, accepting contractual restrictions that prohibit her from using the name for commercial purposes.
Estée Lauder claims that the use of the name on Zara products breaches the contract and misleads consumers. Malone later launched the Jo Loves brand, regretting the sale of her name, which she considers 'the biggest mistake of my life'. Representatives of Estée Lauder emphasize the significant investments in brand development over the past decades.
