Erika Kirk, Charlie Kirk’s wife, is asking the Utah court to reject the defense’s proposal to postpone Tyler Robinson’s trial until 2029. Robinson is accused of murdering the conservative activist. The family is requesting that the trial begin in 2027, citing the emotional impact of the delay on the victim’s two children and the costs borne by taxpayers.

Charlie Kirk was fatally shot on September 10, 2025, during an event organized at Utah Valley University by Turning Point USA. Robinson, 23, is charged with seven offenses, including aggravated murder, and could receive the death penalty if found guilty.

The defense argues that the case is particularly complex, that numerous pieces of evidence are still being analyzed, and that several pretrial motions are yet to be filed. The attorneys believe that setting a firm date too early would create “false precision” and could affect the defendant’s constitutional rights in a capital case.

Prosecutors estimate that they will be ready for trial by October 4, 2027, but propose beginning proceedings on January 31, 2028, to avoid overlapping with the holidays. The trial could last approximately 17 weeks, while the defense estimates a duration of up to seven months. Erika Kirk is also requesting monthly reports on the status of the case.

Context: Before Erika Kirk’s request, the case of Tyler Robinson entered a preliminary stage and was accompanied by allegations regarding event security

Previously, Tyler Robinson, 23, pleaded not guilty in Utah to the murder of conservative activist Charlie Kirk, and the judge ruled that prosecutors may seek the death penalty at trial. In the same case, the next hearing was scheduled for October 23 to determine the next steps.

After Kirk’s death (September 10, 2025, during a debate with approximately 3,000 people at Utah Valley University), his family also filed an official notice accusing the university and state authorities of “reckless decisions,” citing the lack of security measures such as reduced police presence, the absence of drones and metal detectors, as well as the lack of a secured perimeter and paramedics.
