The government has initiated a reform of the Administrative Code, suspending detachments and transfers in the public sector until 2026, with new rules for hiring and reorganization.

The Romanian government has proposed a significant reform of the Administrative Code, aimed at modifying the rules for contractual staff in the public sector. The draft law, which will replace the initially planned emergency ordinance, introduces severe restrictions until December 31, 2026, suspending the detachments and transfers of public officials and contractual staff, with exceptions for defense structures and international institutions.

The competition committees will be reorganized, with ANFP intervening only for management positions, and transfers in the interest of the service will be able to be carried out quickly, without public announcement. In the case of reorganizations, institutions will have to organize internal exams for vacant positions. Additionally, the suspension period of contracts for international activities will be limited to 5 years, and seniority in grade will be extended for certain situations.

The project introduces restrictions on the accumulation of pensions with salaries, reducing service or military pensions by 85% for employees who continue to work. The Ministry of Finance will have control powers and will be able to impose fines between 20,000 and 50,000 lei on institutions that do not comply with the new measures. Exceptions may be granted through a government memorandum in justified cases.
