The General Court of the CJEU has annulled the withdrawal of Ferrari's rights to the 'Testarossa' trademark, ruling that it had been used correctly.

Ferrari has scored a major victory at the General Court of the CJEU, which overturned the EUIPO's decision to withdraw its rights to the 'Testarossa' trademark. The European office had argued that Ferrari did not use the trademark between 2010 and 2015, but the court ruled that the use of the trademark for reselling second-hand models and licensing agreements with toy manufacturers prove actual use. The Testarossa model, famous since the 1980s, was produced between 1984 and 1986 and is now only available second-hand. The legal challenge came from German manufacturer Autec.
