A woman from Iași woke up in an absurd legal situation after inheriting an apartment and a debt from her deceased father. After her parents' divorce, the apartment remained in the mother's ownership, who did not pay the debt to the former husband. After the mother's death in 2012, the woman became the sole heir, taking over both the apartment and the debt. In 2019, after her father's death, she simultaneously became both debtor and creditor for the same amount. When she tried to register the apartment, she discovered that there was a lien owed to her father, and to remove it, a notarized declaration from him was required, which was impossible as he was deceased. The woman asked the court to declare the debts expired, but the judges rejected the request, arguing that a lawsuit cannot be processed against a deceased person. The court suggested that the woman should follow a non-contentious procedure at the Cadastre. The woman contested the decision, and her case will be analyzed by the Iași Tribunal to find a solution to this unusual legal blockage.
