A man contested a fine received following a traffic control, arguing that all mandatory equipment was present in the car, but he did not identify them due to fatigue and the late hour. He explained that he had received the car from his father a few days earlier and had tried to contact him to find out where the equipment was, but his father was asleep.
Later, he discovered that the first aid kit, the vest, and the reflective triangle were in the trunk, while the fire extinguisher was under the driver's seat. In his complaint, the man claimed that he did not endanger road safety and that the fine of 810 lei was excessive, considering that he had not been penalized before.
The Oradea Court accepted the complaint, acknowledging the good faith of the driver, but established that there is no certainty that the equipment was not purchased later. The court decided to replace the fine with a warning, considering that this is a sufficient penalty in this case.
