Former judge Cristi Danileț stated that the complaint filed by the Ombudsman at the Constitutional Court (CCR) against Emergency Ordinance 38 regarding the defense industry is null, as Renate Weber's mandate expired on July 3, 2024.

Danileț emphasizes that the Fundamental Law provides for a 5-year mandate, and Weber has exceeded this limit.

Additionally, the former president of the CCR, Augustin Zegrean, warns that the initiative will have no practical outcome, as a CCR decision would come too late, and Parliament could quickly amend the law.

EO 38, adopted on May 4, aims to adapt the legal framework for investments in the defense industry. Zegrean suggests that a quick solution would be for Parliament to urgently debate the ordinance, having the necessary tools to clarify the legal situation. He also mentions that, in the event of the ordinance's approval, a parliamentary group could refer the matter to the CCR for prior control. The issue of Renate Weber's mandate remains open, raising constitutional questions.
