The Constitutional Court of Romania (CCR) will decide on Tuesday regarding the referrals made by the Alliance for the Union of Romanians (AUR) and the High Court of Cassation and Justice (ÎCCJ) concerning the unconstitutionality of the law on the payment of private pensions.

The High Court of Cassation and Justice (ÎCCJ) argues that the amounts accumulated in Pillar II represent the private property of the participants, and the limitations imposed by law constitute an unjustified interference with the right to property. Furthermore, the ÎCCJ contests the legislative solution that provides for the transfer of pension payments to distinct funds, considering it disproportionate.

AUR accuses the Government of stealing the pensions of Romanians, stating that the amendments undermine citizens' trust in the private pension system. The bill was adopted by the Chamber of Deputies, generating controversy among participants in pension funds.
