The judges of the Constitutional Court (CCR) will rule on Sunday regarding the law proposed by the Bolojan government, which provides for the increase of the retirement age for magistrates and the modification of the pension calculation method, both to be implemented gradually over 15 years. The unconstitutionality complaint was filed by the High Court of Cassation and Justice (ICCJ). Discussions within the CCR have been intense, and the decision has been postponed to December 28, in the context of public protests and reactions to the documentary "Captured Justice."
The law stipulates that the pension of magistrates should be equivalent to 70% of the last net salary, with an extended transition period from 10 to 15 years, so that by 2042, magistrates will retire at 65 years old. Additionally, the amount of the service pension will be 55% of the average gross allowances from the last 60 months, but no more than 70% of the last net allowance. Magistrates can opt for early retirement, but with penalties if they have not reached the standard retirement age.
The report of Judge Simina Tănăsescu, which will be discussed in plenary, does not provide a clear direction for the acceptance or rejection of the complaint, raising several questions. The CCR judges who will make the decision are the same ones who previously rejected the first version of the law, with a vote of 5 to 4.
