Savonea stated that the CCR must analyze all relevant elements before making a ruling, considering the major legal impact of the subject. Regarding the request to refer to the Court of Justice of the European Union (CJUE), she says that it is not a delay, but a necessary legal tool to ensure legal clarity.
Savonea insisted that the duration of the procedure should not be a main criterion, but rather the respect for the principle of the supremacy of European law. The ÎCCJ requested the CCR to verify the compatibility of national measures regarding the special pensions of magistrates with European Union legislation, arguing that these measures may affect the financial security of judges.
