The Foundation for the Defence of Citizens Against State Abuses (FACIAS) has notified DIICOT in connection with Bill B544/2026, registered with the Senate on October 5. The organization claims that, in its current form, the initiative could protect traffickers and encourage drug use.
FACIAS is asking prosecutors to determine whether the bill’s initiators have committed offenses such as aiding the offender or incitement to the illicit use of high-risk drugs. The foundation is also requesting an examination of the funding sources and any financial ties associated with promoting the bill.
The initiative would replace criminal penalties with administrative fines for the possession, purchase, cultivation, production, and manufacture of drugs intended for personal use. The bill also covers bringing drugs into or taking them out of the country for personal use.
At present, these acts may be punishable by imprisonment, including up to 20 years for bringing high-risk drugs into or taking them out of the country. FACIAS also cites data on the effects of drug use: in 2023, 3,089 medical emergencies and 34 deaths associated with drugs were reported.
