The Superior Council of Magistracy (CSM) communicated on February 18 that it took note of the decision of the Constitutional Court which declared the amendments to the special pensions of magistrates constitutional. CSM warns that the new legislative framework will have serious effects on the functioning of the judicial system, including raising the retirement age and eliminating the service pension, which could lead to departures from the system and a profession that is less attractive for future magistrates.
Additionally, CSM emphasizes the shortage of magistrates and the difficulties in recruiting staff, accusing the political and executive power of ignoring these issues. The Council considers it essential to identify measures to prevent a systemic collapse of justice. CSM also mentioned the need to reanalyze the regime of incompatibilities and prohibitions for magistrates. In contrast, President Nicușor Dan appreciated the CCR's decision as a gesture of fairness, while Prime Minister Ilie Bolojan announced steps to recover funds from the PNRR.
