CSM, ICCJ and the Prosecutor's Office have established that the daily allowance for judges for 2026 should be 2% of the gross salary, despite the limit of 23 lei per day set by the Bolojan Government.

On May 12, 2026, the president of the CSM, Liviu Odagiu, the president of the High Court of Cassation and Justice, Lia Savonea, and the general prosecutor, Cristina Chiriac, had a meeting to discuss the application of Law 141/2025 regarding the allowances for judges and prosecutors on secondment. Although the meeting was not published on official websites, an adopted document established that magistrates would not comply with the provision of 23 lei per day, but would continue to receive an allowance of 2% of the gross salary, according to OUG 27/2006.

This decision generated a conflict between the two laws, with OUG 27 being considered a special norm with priority over Law 141, which is general. Critics among the magistrates suggest that the interpretation of the laws is excessive. On May 14, Odagiu formalized the decision, confirming the 2% allowance for 2026.
