The Constitutional Court of Romania (CCR) has decided that municipalities can continue to grant financial incentives for the installation of gas-powered apartment heating systems, rejecting the unconstitutionality claim made by President Nicușor Dan.

This ruling allows the maintenance of an exception from Government Ordinance no. 16/2025, which transposes the European directive on the energy performance of buildings. Local authorities will be able to finance autonomous systems powered by fossil fuels for properties connected to heating points with fewer than 50 users.

Nicușor Dan argued that the extension of these incentives contradicts the European directive, encouraging the use of fossil fuel-based technologies. The CCR concluded that the law complies with the Constitution and that Romania has fulfilled its obligations to transpose the directive, emphasizing that the legislation allows a margin of appreciation in choosing the methods of implementation. The decision is final and generally binding.
