The Constitutional Court of Romania (CCR) decided to postpone the analysis of the referral from President Nicușor Dan regarding the Law amending the Law on electricity and natural gas to March 4, 2026. The President argued that the normative act was adopted beyond the limits of re-examination, requesting the correlation of the definition of prosumer and the re-evaluation of the financial compensation for electricity. He also requested a reassessment of the exceptions for prosumers with an installed capacity of less than 900 kW and clarifications regarding the obligations of energy suppliers. The law, initially sent for promulgation on November 25, 2023, brings significant changes, including an increase in the installed capacity limit for compensation and regulations for prosumers. The President emphasized that the amendments made by Parliament do not respect the request for re-examination but introduce new legislative solutions.
