The CCR admitted the objection of unconstitutionality of the Metrorex law, contested by Nicușor Dan, establishing that it should have been adopted as an organic law, not by ordinance.

The Constitutional Court of Romania decided on Wednesday that the law regarding Metrorex, contested by President Nicușor Dan, is unconstitutional. The judges established that the normative acts regarding the authorization and registration of constructions for the transport infrastructure managed by Metrorex must be adopted through organic law, according to the Constitution. The CCR found that both the Law approving Government Ordinance no. 36/2024 and the ordinance itself are unconstitutional, as they do not meet the requirements of organic law.

Furthermore, the Court emphasized that the amendments made by the ordinance to the existing legislation can only be carried out through normative acts of the same level. However, the CCR concluded that the criticized law does not violate other constitutional articles, having a character of public interest regulation.
