The Constitutional Court of Romania (CCR) will analyze on Wednesday the notification from the president of the PSD, Sorin Grindeanu, who requests the establishment of a constitutional conflict between the Government and Parliament. He accuses the Government of issuing Emergency Ordinance no. 38/2026 after the Parliament withdrew its confidence through a motion of censure, which would constitute a violation of the Constitution.

Grindeanu argues that the Government no longer had the competence to legislate, having only the right to manage public affairs. Furthermore, the Ordinance regulated legislative solutions already under parliamentary debate, transforming the Government into a legislative authority competing with Parliament. He accuses the substantial extension of the ordinance by adding 12 new articles on the day of the vote on the motion of censure, which affects the constitutional balance between the powers of the state.

A similar notification, rejected by the CCR, was also made by AUR, SOS Romania, and PACE.
