The Constitutional Court of Romania (CCR) declared unconstitutional the recent amendments to the Mining Law and the Law on cemeteries, human crematoria, and funeral services. The reason invoked by the CCR: violation of the principle of bicameralism.
This was the result of the objection raised by President Nicușor Dan, who emphasized that the regulations adopted by the Chamber of Deputies introduced essential changes compared to the initially debated form in the Senate, thus violating the principle of bicameralism. The CCR explained that the amendments affected the legal regime of the concession of burial places, without being discussed in the first Chamber. Additionally, the Court found that the significant differences between the two versions of the law contravene the articles of the Constitution regarding bicameralism.
