The former president of the Constitutional Court, Augustin Zegrean, explained on TVR Info that the president has the freedom to propose the same prime minister dismissed by a vote of no confidence, but it is unlikely that he will do so.

Augustin Zegrean, former president of the Constitutional Court, discussed on TVR Info about the constitutionality of the proposal to re-appoint the same prime minister who was dismissed by a vote of no confidence. He emphasized that, although the Constitution does not prohibit the president from making this proposal, the president is not obliged to take into account the suggestions of the parties. Zegrean explained that the president should consult the parties to understand who might gain the support of Parliament, considering that there is no majority party. He also mentioned that, in other countries, it is a common practice for the president to re-appoint a dismissed prime minister, but he stressed that, in the current context, it would be "serious" to make such a proposal, given the votes against the prime minister. Zegrean concluded that the president is not a mere executor of proposals, but has an active role in the government formation process.
