Lindsay Hecox, a final year student at Boise State University, stated that she no longer wishes to compete in university-sponsored sports and has attempted to withdraw her lawsuit. Judge Katanji Brown Jackson asked why the case had not been dismissed. Hecox's attorney, Kathleen Hartnett, emphasized that if the court decides to review the case, it should make a distinction between athletes who take medication to suppress testosterone and other transgender athletes. Hartnett stated that she is not asking the court to allow competition for athletes with an "unfair biological advantage," which would undermine the purpose of separate sports. In cases where sex-based advantages are mitigated, transgender athletes should be accepted. In West Virginia, Becky Pepper-Jackson is the only student seeking access to the women's track team. The Idaho attorney argued that while there has been significant discrimination, it does not compare to the civil rights denials suffered by African Americans and women.
