The case, which is taking place in the federal court in Manhattan, could raise important questions regarding the immunity of foreign leaders and the legality of capturing Maduro. Pollack stated that he expects significant legal disputes, referring to Saturday's operation as a "military kidnapping" and will argue that it was illegal.

He will also argue that Maduro could benefit from immunity against criminal charges, considering his status as the head of a foreign government. However, these arguments face legal difficulties, as the U.S. has not recognized Nicolas Maduro as the leader of Venezuela since 2019, and U.S. courts have been reluctant to dismiss charges based on the illegality of bringing defendants to the U.S.
