Population and territory coverage, the timeline for service availability, the ability to provide Direct-to-Device services, security, resilience, contribution to the European industrial chain, use of European technologies, competition, and efficiency in spectrum use will all count.
This approach shows that the European Union does not just want to sell access to the spectrum. It wants to use it for public objectives: coverage, security, technological autonomy, diversification of suppliers, and reducing strategic dependencies.
What happens with current operators
Current holders of frequency usage rights are Viasat and Echostar. Their rights expire in May 2027. The proposal allows, upon request, the extension of these rights for two years, for the continuity of existing services. During the extension period, the rights cannot be transferred, leased, or sub-leased.
This solution seeks to avoid a service gap between the old system and the new European framework, but without blocking the entry of new operators or the development of Direct-to-Device technologies.
Who controls compliance with the rules
The Commission would monitor compliance with the authorization conditions, together with the member states. If an operator does not comply with the conditions, the Commission could take corrective measures, suspend or withdraw the authorization, and impose fines or periodic penalties.
The text provides for fines of up to 5% of the total global turnover of the license holder in the previous financial year.
This component shows that European authorization comes with European oversight. For an infrastructure considered strategic, the Commission proposes not only common market entry rules but also a common control mechanism.
