The Parliament has adopted a law that cancels the VAT payment obligations and penalties for companies whose VAT code has been revoked by ANAF.
The initiative, supported by parliamentarians from USR, PNL, PSD, UDMR, and the minority group, targets companies that were forced to pay VAT that they did not collect after ANAF revoked their VAT payer code. This has led to situations where small businesses have accumulated debts of tens of thousands of euros.
USR Deputy Adrian Echert emphasized that the law rectifies an injustice and protects entrepreneurs from ANAF's administrative errors. The project establishes the cancellation of VAT differences and the accessories set by the assessment decisions issued as a result of the revocation of the VAT code, for the fiscal periods between January 1, 2019, and the entry into force of the law.
ANAF will automatically cancel the tax obligations, and companies that have already paid will be able to request the refund of the amounts. The statute of limitations for refunds starts from the date of entry into force of the law.
