The High Court of Cassation and Justice decided, on Monday, to reject the appeal filed by prosecutor Bogdan Ciprian Pîrlog, upholding the disciplinary sanction imposed by the Prosecutors' Section of the Superior Council of Magistracy. The court confirmed that Pîrlog committed a disciplinary offense by failing to comply with the orders of his hierarchical superior, which led to a 10% reduction in his gross salary for a period of three months. The High Court emphasized that his actions violated the principle of hierarchical organization of the prosecutor's offices and that non-compliance with legal orders cannot be justified by the professional autonomy of the magistrate.

Additionally, prosecutor Pîrlog has a history of disciplinary issues, having been previously sanctioned for public statements incompatible with the obligation of reserve. The maintenance of the current sanction reaffirms the importance of respecting the professional status of magistrates. In this context, Pîrlog's presence on an advisory committee for the analysis of justice laws raises questions regarding the selection criteria and the credibility of advisory structures.
