The High Court of Cassation and Justice has definitively decided to annul the seizure of over one billion lei imposed on the assets of businessman Viorel Micula, thus confirming the ruling of the Oradea Court of Appeal. The seizure was instituted by the Bihor County Public Finance Administration in an attempt to recover state aid deemed illegal by European courts. In March 2025, the Tax Authority seized the assets of the Micula brothers, following a payment of 300 million euros made by the Romanian state as a result of arbitration. The court established that the Tax Authority did not demonstrate a real risk of asset dissipation, and the modifications to the amounts could not be made through a simplified procedure. The judges emphasized that measures of unavailability are exceptional and require concrete evidence. The case involving Ioan Micula continues at the supreme court.
