Judge Alin Ene, a member of the Superior Council of Magistracy (CSM), vehemently criticized the statements of President Nicușor Dan regarding the organization of a referendum among magistrates to evaluate the activity of the CSM. Ene emphasized that there is no legal basis for such an initiative, which would violate the principle of separation of powers in the state. He compared the situation to a referendum organized by Justice for the dismissal of the President or the dissolution of Parliament, highlighting that the removal of CSM members can only be done by the decision of the General Assemblies of judges. The judge warned that plebiscitary-type actions can erode the rule of law and create disappointment among magistrates. In contrast, Nicușor Dan announced that he will organize a referendum in January to determine whether the CSM acts in the public interest or in the interest of a guild, emphasizing that the result will influence the future of legislative discussions.
