The High Court of Cassation and Justice (ICCJ), led by Lia Savonea, submitted a formal request on February 10, 2026, to the Constitutional Court of Romania (CCR) to refer to the Court of Justice of the European Union (CJEU) through a preliminary question regarding the reform of the special pensions of magistrates. This action marks a new stage in a legal and political conflict that has generated intense debates within the judicial system.

The request comes in the context in which the CCR is analyzing an objection of unconstitutionality filed by the ICCJ against the law that modifies special pensions. The ICCJ requests the CCR to activate Article 267 of the Treaty on the Functioning of the European Union to obtain a viewpoint from the CJEU regarding the compatibility of the new provisions with European law.

This initiative arises during a period of procedural uncertainty at the CCR, where debates have been affected by delays and the absence of a judge. The ICCJ emphasizes that the preliminary question aims to verify the compatibility of national measures with the requirements of European Union law. Judges warn that the contested provisions could violate fundamental principles of European law, essential for the status and independence of magistrates. The CCR will decide whether to accept the ICCJ's request, and a preliminary question could suspend the internal analysis, thus prolonging the process of reforming magistrates' pensions.
