The law adopted in November last year, which includes provisions for the tax exemption of cryptocurrency gains, has not yet come into force. It was challenged by former president Klaus Iohannis at the Constitutional Court, which rejected the objection of unconstitutionality in July, stating that the law prevents double payment of contributions. Recently, President Nicușor Dan sent the law back to Parliament for re-examination, emphasizing that the current form contradicts the principles of tax equity and commitments from the National Recovery and Resilience Plan (PNRR).
Additionally, the tax on cryptocurrency gains will increase from 10% to 16% starting in 2026. The president warned that the exemption would create a dangerous precedent and undermine trust in the state's fiscal policies. The bill will now be subject to a final vote in Parliament.
