More than 27,000 military pensioners could receive, automatically, the money withheld through the progressive tax after the Constitutional Court declared unconstitutional the tax provisions underlying the taxation. The proposal was submitted to Parliament by Radu Miruță, an MP from the Save Romania Union (USR) and former minister of National Defence.
The bill provides for the staggered reimbursement, from the state budget, of amounts withheld in excess of the standard 10% rate from service pensions and military pensions. The withholdings made between January 1, 2024, and January 30, 2025, are covered.
According to the initiative, reimbursements would begin in December 2026, with a 10% instalment, and continue in March 2027, when a 40% instalment is scheduled. However, the bill must be adopted by Parliament and promulgated to enter into force.
The measure follows Constitutional Court Decision No. 724/2024, which removed from the Tax Code the provisions declared unconstitutional and introduced through Law No. 282/2023. However, the decision did not establish the automatic reimbursement of amounts already withheld.
So far, nearly 3,000 military pensioners have sued the state, while more than 2,100 have obtained favourable rulings. In these cases, the state's obligations amount to 8.4 million lei, of which 800,000 lei represent legal costs.
