The High Court of Cassation and Justice has ruled in favor of ANAF, maintaining the precautionary measures imposed on the Micula brothers' companies, SC European Food SA and SC Transilvania General Import Export SRL. These measures were instituted to ensure the recovery of state aid granted illegally, according to a decision by the European Commission from 2015. The court confirmed the legality of the seizure of the assets of these firms, thus protecting the interests of the Romanian state. ANAF acted in 2024 to prevent the disposal of assets and ensure the recovery of the amounts owed. Additionally, searches were conducted at the premises of the Micula brothers' companies, targeting tax evasion and embezzlement related to state aid. The Micula brothers, Swedish investors, previously obtained compensation from Romania through an arbitration tribunal, but the European Commission stated that these payments constitute illegal state aid.
