The Constitutional Court rejected the request of the President of Romania and declared constitutional the law that regulates interventions against the heirs.

The Constitutional Court decided, by a majority vote, that the law amending Emergency Ordinance no. 81/2021 regarding interventions against bears is constitutional.


This establishes a prevention level of 859 brown bear specimens and an intervention level of 110 specimens for the years 2026 and 2027, the measure being justified by the need to prevent attacks on people and material damages. The Court emphasized that the Habitats Directive allows for derogations from the prohibition of capturing protected species, including the brown bear. The law was developed based on scientific data indicating an excessively large brown bear population, and alternative solutions are insufficient.


The decision is final and generally binding, and Parliament has the right to establish these measures. The Court also rejected arguments related to the separation of powers in the state, stating that the regulation of species protection is not exclusively the prerogative of the executive authorities. Additionally, the criticism regarding the lack of a sanction for the removal of females with cubs was dismissed, considering that the text must be interpreted together with existing legislation.
