The CCR declares the capping of salaries for persons with disabilities unconstitutional.

The Constitutional Court of Romania has decided, by a majority vote, that the provisions of art.11 para.(4) of Framework Law no.153/2017, which caps the salary income of persons with disabilities at the level of the monthly allowance of the deputy mayor, are unconstitutional.

The Court found that this capping generates discrimination between persons with disabilities who receive bonuses and those who do not, contrary to the principle of equality in rights provided by the Constitution. The CCR decision emphasizes that the 15% bonus for persons with disabilities must be calculated and paid separately, without being affected by the salary cap.

Thus, employees with disabilities in municipalities and county councils will benefit from real social protection, and public institutions are required to revise the method of calculating salaries in accordance with this decision.

The ruling is final and generally binding, having immediate effects on the salary rights of persons with disabilities.
