Judge Liviu Cârneci stated that the justice system in Romania lacks effective internal self-correction mechanisms, consolidating an oligarchic system, with power concentrated at the top of the High Court of Cassation and Justice and the Superior Council of Magistracy (CSM). Cârneci emphasized that the procedures affecting judges' careers lack transparency and objectivity, and abuses are not corrected from within. He mentioned cases of double standards in the activity of the Judicial Inspection, where some judges were disproportionately sanctioned, while others escaped consequences for inappropriate behavior. Cârneci referred to the case of former judge Cristi Danileț, who won at the ECHR, highlighting the importance of freedom of expression for judges. This situation generates a state of generalized fear among judges, who feel excessive control over their careers.
