Luisiana Dobrinescu, lawyer and partner at Dobrinescu Dobrev Haraga, stated that although ANAF has started controls in the cryptocurrency area, the current legislation is unclear, which can lead to litigation for taxpayers.
Recently, ANAF approved an order that requires cryptocurrency service providers to report annual data about accounts and transactions. Dobrinescu highlighted that while tax obligations for individuals are clear, companies in the field face uncertainties. The Ministry of Finance has not developed specific accounting rules for cryptocurrencies, and their accounting remains problematic.
Dobrinescu mentioned that the value fluctuations of cryptocurrencies complicate their management, and the lack of clear regulations can lead to controversial enforcement decisions from ANAF. This situation could generate a tax amnesty, affecting both the budget and the efforts of taxpayers and lawyers.
